【分析與結論】

本案之提單標示兩 艘 船 名，而僅有一港名 ( 註： 指 裝載
港 ) 。此為標有裝 船日期 之備運型態 (Received for Shipment

type) 提單；而提單標示兩 艘 船 名，已不符合 UCP500 第 23 條
a 項 ii 款所規定之 — 表明 貨物 已裝載於標名之 船 舶 上，因此，
其裝 船 註 記 須顯示 與 裝 船 相關之實際 船 名 (The on board

notation should include the name of the vessel to which the on
board notation refers.) ；且提單於 Port of Discharge 欄 位 註明

Huangpu/China Via Gioia Tauro and Hong Kong ，此未明示 越 洋
之 貨船 “Vessel C” 從 Gioia Tauro 經由 Hong Kong 至
Huangpu/China ，即提單未明確表示 那 一 艘 船從 那 一港 口 啟
