SWIFT should ensure in accordance with SWIFT rules that the appropriate
UCP incorporation clause was included in the credit advice sent to the

beneficiary.

經由 SWIFT 方式開發之信用狀，其通知銀行應確實遵照 SWIFT 規
則，於信用狀通知書上敘明適用統一慣例之規定後始交付給受益人。

三、傳統信用狀常載有確切保證字眼，諸如：

“We hereby agree with the drawers, endorsers and bona fide holder of
all drafts drawn and documents presented under and in compliance with the

terms of this credit that such drafts and documents will be duly honoured on
due presentation to the drawer/us.”

L/C 之所以發揮其功能，就在這句確切保證的承諾，開證銀行須對其
所規定之條件、條款之文義負責。由第二點說明得知 SWIFT 之 L/C 適用

統一慣例，而該慣例 (UCP500) 第九及十條對於開證銀行之義務已有所規

定，SWIFT 之 L/C 省去了確切保證字眼，但開狀銀行仍負確切保證義
務。
註：前 UCP500→現為 UCP600
