近年來由於世界經濟激烈波盪，影響及於國際貿易，較嚴重之一種
現象為某些國家在大量進口物資態勢下，港口頓成擁擠不堪。船舶進口

無法立即靠碼頭卸貨，必須按次序排隊等待，經過一段相當時間，短者
十數天，長者八、九個月，方輪到靠岸機會。在這段等待期間，貨物堆

存船上，難免海上危險之威脅，而保險公司之承保責任，依照通常之條
款，遲遲未能解除，使其無法忍受，因此乃有本條款之出現。

本條 款主要用 意在更改 協會貨物 水險條款 中第一條 “ Transit
Clause＂之規定，針對港口壅塞時得提前解除保險公司之責任。本條款規

定載貨船舶抵達最終卸貨港如未能及時卸貨，則自船到當天午夜起算，
經過六十天由未卸完貨物，保險效力即行終止，但貨主如事先通知保險

公司並願加繳保險費，則保險公司亦可同意延長此項期限。不論在六十

天或同意延長之期限內，貨物自船上卸下完畢，此項期限即行終止，改
由原協會貨物水險條款中第一條之規定繼續承保，下面為本條款之條
文：

Port Delay Clause

Notwithstanding the provisions of Clause 1 of the Institute Cargo
Clauses, this insurance shall terminate on the expiry of 60 days from

midnight on the day of arrival of the oversea vessel at the final port of
discharge of the goods hereby insured if their discharge has not by then been

completed. Thereafter subject to prompt notice being given to underwriters
the goods shall be held covered for a period and at a premium to be arranged.

The period of up to 60 days specified above or any extension thereof shall
nevertheless terminate immediately upon completion of discharge overside

from the oversea vessel and continuation of cover shall thereupon be
governed by the provisions of clause 1 of the Institute Cargo Clauses or any
