第三章  出口押匯相關疑難問題  137






                                  在任何情形之下,被保險人及其代理人有責任採取適當之措施以防
                             避或減輕損失,並確保所有可對抗運送人、受託人或第三者之權利,得

                             以完整掌握與行使。

                             無受益條款 (Not to Inure Clause)
                             12.This insurance shall not inure to the benefit of the carrier or other bailee.


                                  運送人或其他受託人均不得享受本保險之利益。

                             雙方過失碰撞條款 (Both to Blame Collision Clause)

                             13.This  insurance is extended to indemnify the Assured against such
                                proportion of liability under the contract of affreightment “Both to Blame

                                Collision” Clause as is in respect of a lossrecoverable hereunder.
                                In the event of any claim by shipowners under the said Clause the

                                Assured agree to  notify the Underwriters who shall have the right, at
                                their own cost and expense, to defend the Assured against such claim.


                                  本保險被擴張至補償被保險人在運送契約中「雙方過失碰撞」條款
                             下所負責之部分,如同可在本保險受償之損失。

                                  當船主根據該條款索償時,被保險人同意通知人保險人,保險人有
                             權以自費替被保險人對該項索賠提出抗辯。

                             捕獲扣押不賠條款 (F.C.& S. Clause)

                             14.Warranted free of capture, seizure, arrest, restraint or detainment, and the

                                consequences thereof or of any attempt thereat; also from the
                                consequences of hostilities or  warlike operations,  whether there be  a
                                declaration of war or not; but this warranty shall not exclude collision,
