9. 購買 (procure) 已如此交付之貨物交貨

配合 大宗 物資 在貨 物運 送途 中之 轉售 ，在 FAS 、 FOB 、

CFR 及 CIF 條規有關交貨之規定，增訂“…by procuring
the goods so delivered ＂ (… 購買已如 此 交付之 貨 物，例

如：已放置船舶邊之貨物，或已裝運於船舶之貨物)。

10. FOB、CFR 與 CIF 條規之賣方交貨

FOB、CFR 與 CIF 條規有關賣方交貨之規定，修訂為：賣

方必須將貨物運送至指定裝運港並裝載於買方所指定之船
舶上 (…deliver the goods either by placing them on

board the vessel nominated by the buyer…) ，此不 同於
2000 年版 國貿條 規 之「越 過 船舷」 (…when the goods

pass the ship’s rail…)。

 如何正確使用國貿條規？

1. 將國貿條規載入買賣契約並載明適用之版本

當事人如擬使用國貿條規時，應將條規載入買賣契約並載

明 適用之版 本，新版 國貿條規 之引言 (introduction) 即表
示： “ …You should make this clear in the contract,

through such words as the chosen Incoterms rule
including the named place, followed by Incoterms

2010.”，即國貿條規之三個縮寫字母後面填寫指定之地點
