小，此種條款稱為「限制條款」，其目的就是限制賠償責任，來函所詢
INSTITUTE REPLACEMENT CLAUSE 中譯為「協會重置條款」即為保

險人為限制之賠償責任之條款之一種。
由於機械或精密之儀器在運輸途中，如有部分零組件受損，機械運

達目的地後，將無法正常運轉，在此種情況下，被保險人如以委付方式
向保險公司要求「全部賠償」，勢必發生爭議。因此，保險公司為免除

無謂糾紛，在承保機械組合之運輸保險時，在保險公司為免除無謂糾
紛，承保機械組合之運輸保險時，在保險單上加貼「協會重置條款」，

言明機械如因保險事故，而致部分零組件受到毀損或滅失，則保險公司
負責賠償之金額，不能超過該受損之零件重置費用或修理費用加上運費

及改裝費，若關稅在承保範圍內，發生零組件減失運補時，關稅可一併

賠償，但保險公司之責任絕不超過整套機械之保險金額，茲列述原文內
容，以供參考。
Institute Replacement Clause

In the event of loss of or damage to any part or parts of an insured

machine caused by a peril covered by the Policy the sum ecoverable shall
not exceed the cost of replacement or repair of such part or parts plus

charges for forwarding and refitting, if incurred, but excluding duty unless
the full duty is included in the amount insured, in which case loss, if any,

sustained by payment of additional duty shall also be recoverable.
Provided always that in no case shall the liability of Under-writers

exceed the insured value of the complete machine.
